By accessing and using Will Buddy ("the Service"), you agree to these Terms:
By accessing Will Buddy, you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use our Service.
You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction. By using our Service, you represent and warrant that you meet these requirements.
You must provide accurate, current, and complete information during registration and maintain the accuracy of such information. You are responsible for safeguarding your account credentials.
These Terms become effective when you first access our Service. We may update these Terms periodically, and your continued use constitutes acceptance of any changes.
Will Buddy provides AI-powered will creation and management services:
Our advanced AI technology creates personalized will documents based on your inputs, designed to align with Australian will-execution requirements while maintaining simplicity and clarity.
We provide secure storage, version control, and editing capabilities for your will documents. You can update your will anytime as your circumstances change.
WillBuddy helps you prepare a will for any Australian state or territory. For a will to be valid, it generally has to be signed and witnessed the way the law of your state or territory requires. WillBuddy shows you how for your state when you print your will.
We offer customer support, educational resources, and guidance throughout the will creation process. Our service includes chat-based AI assistance for will modifications.
If you use the WillBuddy app in ChatGPT:
The app gives general information about wills in Australia, helps you gather the answers a will usually needs, checks them against WillBuddy's rules and, if you ask, gives you a one-time link to continue on WillBuddy. It doesn't write or store a will in ChatGPT, and it can't see or change your WillBuddy account.
The app does not give advice about your situation and is not a substitute for a solicitor. Where your circumstances may need extra care, it says so and suggests speaking with one.
ChatGPT writes its replies itself, using OpenAI's AI models. WillBuddy provides the checks and the link, not the wording of the conversation. Check anything important on WillBuddy's pages or with a solicitor.
Your use of ChatGPT, and your conversation, are governed by OpenAI's terms and privacy policy. These Terms cover the WillBuddy app and WillBuddy itself.
When you open your link, these Terms and our Privacy Policy apply as they do to anyone using WillBuddy. You can review and change every answer before your will is drafted.
As a user of Will Buddy, you agree to the following responsibilities:
You must provide true, accurate, and complete information about yourself, your beneficiaries, and your assets. Inaccurate information may render your will invalid or ineffective.
You are responsible for ensuring your will complies with local laws and is properly executed according to your jurisdiction's requirements, including witnessing and signing procedures.
You must maintain the confidentiality of your account credentials and immediately notify us of any unauthorized access. You are responsible for all activities under your account.
You agree to use our Service only for lawful purposes and in accordance with these Terms. You must not use our Service to create fraudulent or malicious documents.
You acknowledge that complex estates or unique circumstances may require professional legal advice. You are responsible for determining when such consultation is necessary.
You are responsible for keeping your will current as your circumstances change, including updates to beneficiaries, assets, and personal information.
Details about your account, subscription options, and billing:
New users can create their first will draft, including its automatic review, free of charge, plus 3 free AI edits. To print your will, or to keep editing after the free edits, you'll need a paid plan.
We offer an Annual Subscription ($39 AUD/year) for edits and versions of your own will (one will per subscription) and storage for 12 months. Your subscription includes a fair-use allowance of 50 AI edits a year; additional credits are available (e.g. 30 for $10).
Annual subscriptions automatically renew unless cancelled. We'll email you about a month before renewal, and you can cancel any time before it renews.
You can upgrade, downgrade, or cancel your subscription anytime through your account settings. Changes take effect at the next billing cycle.
Free trial and expired subscription accounts retain read-only access to documents. Annual subscribers maintain full access while subscription is active.
Each subscription includes edits and versions of your own will (one will per subscription), within the AI allowance above. Additional wills for family members require separate accounts or subscriptions.
Will Buddy is not a law firm and does not provide legal advice. Our Service uses AI technology to help you create legal documents based on the information you provide.
No solicitor–client (legal practitioner–client) relationship is created between you and Will Buddy. Our Service is not a substitute for professional legal counsel.
Document review recommended: We strongly recommend having any will created through our Service reviewed by a qualified Australian legal practitioner (solicitor) in your jurisdiction before execution.
Will execution requirements vary by state and territory. You are responsible for ensuring your will meets local requirements for witnessing, signing, and other formalities.
Our Service may not be suitable for complex estates involving trusts, business interests, international assets, or complicated family situations. Professional advice is recommended for such cases.
Will Buddy does not provide tax advice. Estate planning may have significant tax implications. Consult with a tax professional or estate planning solicitor / legal practitioner for tax-related matters.
While we strive to create legally compliant documents, we cannot guarantee that your will is valid or will achieve your intended results without proper execution and legal review.
Understanding ownership of content and intellectual property rights:
You retain all rights to the personal information and content you provide. Your will document and its contents remain your property. We only use your information to provide our services.
Will documents created by our AI are owned by you. You have full rights to use, modify, and distribute your will as needed. We claim no ownership over your generated documents.
Will Buddy's software, AI technology, templates, and systems remain our property. You receive a license to use our Service but not ownership of the underlying technology.
Any feedback or suggestions you provide about our Service may be used by us without compensation to improve our offerings, though your personal data remains protected.
Important limitations on our liability for the Service:
Apart from the guarantees you have under the Australian Consumer Law, we don't give other warranties about the Service. We can't promise it will always be available, error-free or completely secure.
Where the law allows a limit, our total liability for any claim is limited to the amount you paid for the Service in the past 12 months. This limit doesn't apply to your rights under the Australian Consumer Law that can't be excluded.
Except where the Australian Consumer Law entitles you to compensation for reasonably foreseeable loss, we are not liable for indirect or consequential loss, including lost profits.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law that cannot be excluded.
Legal jurisdiction and dispute resolution procedures:
These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree to submit to the jurisdiction of Victorian courts.
We encourage resolution of disputes through good faith negotiation. If that fails, disputes will be resolved through mediation before resorting to the courts of Victoria, Australia.
Information about service uptime, maintenance, and availability:
We aim for high availability but do not guarantee uninterrupted access. Occasional maintenance and updates may temporarily affect availability.
We perform regular maintenance during low-usage periods. When possible, we'll provide advance notice of scheduled downtime via email or in-app notifications.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We'll provide reasonable notice for significant changes affecting your access.
Your documents remain accessible even during service interruptions. We use redundant backups designed to minimise the risk of data loss.
How accounts can be terminated and what happens to your data:
You can cancel your plan at any time from your account. It stays active until the end of the period you've paid for, and you can still read your will afterwards. To delete your account, email team@willbuddy.com.au.
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse our Service. We'll provide notice unless doing so would compromise security.
When your plan ends, you can no longer edit, download or print your will, but you can still read it here. Ending your plan does not change a will you have already printed and signed. We keep only the data the law requires or that we need for legitimate business purposes.
Provisions related to intellectual property, limitation of liability, and governing law survive termination. Your obligations regarding accurate information also continue.
Two discounts can lower what you pay when your plan renews. Each reduces the price of your own plan only.
If your paid plan is set to renew and you send us feedback in the app, whatever rating you give, we take $10 off each later renewal of that plan. It is a thank-you for feedback, never for a review: whether you review us anywhere is up to you and doesn't change it. If your plan ends (you cancel and your paid time runs out, or it stops after failed payments), the reward ends with it, and it doesn't come back if you subscribe again.
Each customer whose paid plan is set to renew has a personal link. Someone who opens WillBuddy from your link, makes a new account and takes out their own paid plan is your referred friend while their plan is set to renew. With one referred friend, your renewals are 50% off. With two or more, your renewals are free (100% off). Your friend doesn't get a discount from your link.
Your plan can carry only one discount at a time, so we roll the two into one for you. With the feedback reward and one referred friend, the $10 comes off first and then 50% (a $39 plan renews at $14.50). With two or more referred friends, your renewal is free. If we have given you a bigger discount another way, we keep the bigger one.
We check your discount every day, and straight away when a referred friend's plan starts or stops renewing. Your renewal is charged with the discount that applies on the day it renews, so it can differ from the amount in your renewal reminder. If your referral discount changes, we email you the new price. If your price goes up and you'd rather not renew, you can cancel any time before your renewal day.
Your friend must open your link and make a new WillBuddy account on the same device and browser within 30 days. If they open more than one person's link, the last one counts. Your own accounts don't count, and nor does a plan paid with the same card as yours. Share your link only with people you know, and if you post it where strangers can see it, say that you get a discount. We may stop counting a referral if we reasonably believe it breaks these rules, for example a fake account, a link sent as spam, or a link used in paid ads. If that changes your discount, we email you. If you think we got it wrong, email team@willbuddy.com.au and we will look again and tell you why.
Discounts only reduce what WillBuddy charges for your own plan. They have no cash value and can't be transferred or swapped for a refund. This doesn't limit your rights under the Australian Consumer Law.
We may change or end the referral discount, and stop offering the feedback reward for new feedback. A feedback reward already on your plan stays for as long as your plan keeps renewing. If a change would make any renewal cost you more, we will email you at least 30 days before that renewal, and you can cancel before then.
Pricing, billing, and refund policies:
Current pricing: Annual Subscription $39 AUD/year. WillBuddy is not registered for GST, so no GST is included or charged. We reserve the right to change prices with 30 days notice.
We accept major credit cards and debit cards through secure payment processors. All payments are processed in Australian dollars (AUD).
You can read your whole will free before you pay, so we don't give refunds for change of mind, unless the next item applies to you. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. If something is wrong, email team@willbuddy.com.au. Refunds go back to the card or account you paid with.
We used to offer a 14-day money-back guarantee for first-time subscribers. If you created your account on or before 3 October 2026, it still applies to a first payment made on or before 2 November 2026: ask within 14 days of that payment and we'll refund it in full. After that, the refund terms above apply to everyone.
If payment fails for subscriptions, we'll attempt to process it again. After multiple failures, your account may be downgraded to read-only access until payment is resolved.
WillBuddy is not registered for GST. Our prices include no GST, and we don't issue tax invoices.
Promotional pricing is valid only for the specified period. Regular pricing applies upon renewal unless the promotional terms or Renewal discounts say otherwise.
How we update these Terms and notify you of changes:
We may update these Terms at any time to reflect changes in our Service, legal requirements, or business operations. Check this page periodically for updates.
For material changes, we'll notify you via email or prominent notice within the Service at least 30 days before the changes take effect.
Your continued use of Will Buddy after changes take effect constitutes acceptance. If you disagree with changes, you may close your account before they take effect.
We maintain a record of Terms updates. You can request previous versions to understand what has changed over time.
